The Senate parliamentarian has ruled in favor of the provision that restricts states from regulating artificial intelligence.
Parliamentarian Elizabeth MacDonough said the measure can be included in the reconciliation bill as long as the AI freeze applies to states’ access to a new $500 million pot of AI infrastructure funding, according to Senate Budget Committee Democrats.
MacDonough had reopened arguments on the provision this week after previously greenlighting its inclusion in the package. Her ruling clarifies that under the reconciliation bill, the decade-long freeze on AI laws should not be a condition for states’ access to a $42 billion federal broadband program.
