Sen. Mark Kelly (D-Ariz.) asked a federal court Monday to vacate efforts by the Defense Department to punish him for statements advising service members to ignore illegal orders.
In his lawsuit, Kelly asked the court to rule a censure and related actions to dock his military grade and pension benefits as “unlawful and unconstitutional” and “to vacate those actions.”
The move comes a week after Pentagon Secretary Pete Hegseth announced DOD had censured Kelly for his “seditious comments” and initiated proceedings to demote the retired Navy captain. Any demotion would lessen Kelly’s retirement pay.
