There’s bipartisan interest in Congress to regulate how college athletes make money using their name, image and likeness, but how to grapple with the labor issues has emerged as a major hurdle to any legislation.

Lawmakers on both sides of the aisle agree that Congress needs to step in with legislation to create national standards for NIL and a college athletics regulatory structure. But a recent Senate HELP Committee hearing showed how difficult it will be to resolve the question of whether college athletes should be considered employees. (Read the hearing transcript here)
