House FTC antitrust change faces Senate skepticism

The House Judiciary Committee’s plan to move the Federal Trade Commission’s antitrust enforcement authority to the Justice Department is facing skepticism in the Senate.

The House panel is marking up its portion of the GOP reconciliation package at 2 p.m. today. But key senators are unsure the FTC provision would be allowed under the chamber’s reconciliation rules.

“We'd love to get it through, but I don't have a firm answer,” said Sen. Mike Lee (R-Utah), who has long led the effort to combine the antitrust and merger work done by the FTC and DOJ.
